NIC ARGENTINA ESTABLISHES NEW CRITERIA FOR RESOLVING DOMAIN DISPUTES

The National Directorate of Internet Domain Registration (NIC Argentina) took an important step towards transparency and efficiency in the resolution of domain disputes by publishing in writing the criteria it uses to analyze and resolve these cases.

Domain disputes are administrative procedures that allow a third party to claim ownership of an Internet domain registered by another party, when it considers that the latter does not have a legitimate right to it.

Provision 187/2023 establishes a series of general criteria that NIC Argentina takes into account when resolving domain disputes. These criteria are based on the principles of good faith, legality and non-infringement of third party rights.

Some examples of cases in which a domain can be revoked are the following:

  • When the domain creates confusion, deception or impersonation with respect to a registered trademark, copyright, company names or proper names.
  • When the domain is used for purposes contrary to good faith, such as speculation, blocking other users or illegitimately diverting web traffic.
  • When the domain is not used for real digital activity or when it has not been delegated to DNS within a reasonable period.
