The National Institute of Industrial Property of Argentina (INPI) has issued Resolution No. 162/2026, establishing a new regulatory framework for recording ownership transfers and name or corporate name changes related to trademark, patent, utility model and industrial design rights.
The new regulation aims to simplify and modernize these administrative procedures, incorporating more flexible criteria and greater legal certainty for intellectual property rights holders.
Among the most relevant changes is the elimination of the apostille or consular legalization requirement for foreign documentation submitted in support of recording assignments or name changes. The resolution also clarifies that recording before the INPI is merely declaratory, with retroactive effect to the filing date of the corresponding application.
These measures represent a significant improvement for foreign holders and companies with international intellectual property portfolios, reducing formalities, costs and time associated with updating records in Argentina. They also provide greater predictability in corporate transactions, corporate restructurings, acquisitions and other transactions involving intellectual property assets.
