The Mexican Institute of Industrial Property (IMPI) has implemented a new mechanism to accelerate the patenting process in the country, benefiting Mexican inventors and innovators.
We are talking about the Accelerated Patent Grant Agreement (APG) which is a procedure that allows for the acceleration of the granting of applications for patents, utility models and industrial designs in Mexico.
The APG is intended for applicants who have already obtained a corresponding patent from the United States Patent and Trademark Office (USPTO).
- To access the APG, the Mexican application must meet the following requirements:
- Have a corresponding US application that has been granted and published.
- Claim priority to the US application or have a common priority.
- That all claims in the Mexican application sufficiently correspond to the US patent.
- Having been published and having concluded the third-party observation period.
Applications claiming subject matter that is not patentable in Mexico are not eligible for the APG. In addition, there are restrictions on divisional applications and specific deadlines for submitting the application to participate.
The APG application process is simple and is carried out through the IMPI portal. The Mexican application number and the US patent publication number are required.
