New Regulation on IP Ownership Transfers and Name Changes

The Argentine National Institute of Industrial Property (INPI) has issued Resolution No. 162/2026, establishing a new regulatory framework for the recordal of ownership transfers and name or corporate name changes relating to trademarks, patents, utility models, and industrial designs.

The new regulation aims to simplify and modernize these administrative procedures by introducing more flexible requirements and greater legal certainty for intellectual property rights holders.

Among the most significant changes is the elimination of the apostille and consular legalization requirements for foreign documents submitted in support of assignment recordals and name change requests. The resolution also clarifies that recordals before the INPI are declaratory in nature and produce effects retroactively from the filing date of the corresponding request.

These measures represent a significant improvement for foreign rights holders and companies managing international IP portfolios, reducing the administrative burden, costs, and processing times associated with updating ownership records in Argentina.
